Terms & Conditions

These Terms form a binding agreement between Links Capital Group LLC and you, the person accessing our website. They apply to www.linkscapitalgrp.com, its pages and subdomains, applications, document-upload tools, forms, content, features, and services.
1. Eligibility; Business Purpose Only
The Site is intended for adults with legal capacity to contract. If you use it for a business, you represent that you are authorized to bind that business. Our Services are solely for commercial and business purposes, not personal, family, or household purposes.
2. Who We Are: A Broker, Not a Lender
Links Capital Group LLC is a commercial financing brokerage, not a direct lender. Funding Partners alone determine approvals, denials, amounts, rates, fees, terms, and conditions. We do not guarantee an offer or funding. Nothing on the Site is legal, tax, accounting, or financial advice.
4. Merchant Cash Advances Are Not Loans
Some products are purchases of a portion of future receivables at a discount, not loans. Repayment may be tied to sales or revenue. Specific terms and reconciliation rights are governed by the Funding Partner agreement.
5. How We Are Paid
There is no charge to apply through the Site. Links Capital is typically compensated by the Funding Partner through a commission or broker fee, as disclosed where required.
6. State-Required Disclosures
Where required, written disclosures will be provided before you sign a financing agreement.
7. Intellectual Property
Site content is owned by Links Capital or its licensors. You receive a limited, revocable, non-exclusive permission to use the Site for internal business purposes, applying for financing, and communicating with us. All other rights are reserved.
8. Prohibited Uses
- Access data not intended for you or collect information about others.
- Probe, scan, bypass security, disrupt the Site, upload malicious code, or overload systems.
- Use bots, scrapers, crawlers, or automated tools to harvest Site data.
- Submit false or misleading applications, impersonate anyone, or violate applicable law.
9. Privacy and Security of Transmissions
Your use is also governed by our Privacy Policy. We use reasonable safeguards, but no transmission or storage is completely secure.
10. Document Uploads
You represent that uploaded documents are authentic and that you have the right to share them. You authorize their storage, review, and sharing as described in these Terms and our Privacy Policy.
11. Third-Party Websites and Services
Third-party services are governed by their own terms and policies. Links Capital does not control or guarantee them.
12. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. LINKS CAPITAL DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW AND DOES NOT WARRANT ANY PARTICULAR OUTCOME, INCLUDING ANY FUNDING OFFER OR APPROVAL.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE LINKS CAPITAL PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. TOTAL AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SITE, CONTENT, OR THESE TERMS WILL NOT EXCEED US $100.
14. Indemnification
You agree to defend, indemnify, and hold harmless the Links Capital Parties from claims, losses, damages, costs, and expenses arising from your use of the Site, submitted information, breach of these Terms, or violation of law or third-party rights.
15. Availability of the Site
The Site may be unavailable because of maintenance, failures, traffic, or other causes. It is intended for businesses in the United States.
16. Consent to Electronic Communications
By using the Site or submitting an application, you consent to electronic communications and agree electronic records and signatures have the same legal effect as paper records.
17. Telephone Calls and Call Recording
Calls may be monitored or recorded for quality assurance, training, compliance, and record-keeping. By providing a number and consenting where requested, you agree that Links Capital and those acting on its behalf may contact you about your application, account, and business financing. Consent to marketing calls or texts is not a condition of service.
18. SMS / Text Messaging Program Terms
By separately opting in to SMS, you agree to receive application and account messages. Message and data rates may apply. Message frequency varies. Reply HELP for help and STOP to opt out. No mobile information, including phone numbers and SMS opt-in data and consent, will be shared with third parties or affiliates for their marketing or promotional purposes. See our Messaging Policy.
20. Suspension, Termination, and Enforcement
We may deny, suspend, or terminate access with or without notice and may investigate suspected violations and cooperate with law enforcement or regulators.
21. Minors
The Site is not directed to anyone under 18. Do not submit an application or personal information if you are under 18.
22. Governing Law and Venue
These Terms are governed by Texas law and applicable federal law. Subject to Section 23, claims must be brought in state or federal courts in Harris County, Texas.
23. Dispute Resolution: Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. MOST DISPUTES MUST BE RESOLVED IN INDIVIDUAL BINDING ARBITRATION, NOT IN COURT. YOU AND LINKS CAPITAL WAIVE THE RIGHT TO A JURY TRIAL AND AGREE NOT TO PARTICIPATE IN CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDINGS. Before arbitration or court action, the parties must send written notice and attempt informal resolution for at least 30 days. You may opt out within 30 days by emailing info@linkscapitalgrp.com with the subject "ARBITRATION OPT-OUT" and your name, business name, and contact information.
24. General Provisions
These Terms and referenced policies are the entire agreement regarding the Site. Failure to enforce a provision is not a waiver. Invalid provisions will be limited or severed, and the remaining provisions remain in effect.
